For Petitioner : Mr.G.Jeremiah for Mr.B.Nambiselvan For Respondents : Mr.S.Surya Government Advocate https://www.mhc.tn.gov.in/judis WP No. 31666 of 2026 __________ Page2 of 4 ORDER Challenge made in this Writ Petition is to the order passed by the second respondent vide Na.Ka.No. 208/1436 dated 01.08.2026 directing the petitioner to vacate and handover the shop Nos.1,2,4 and 5 belonging to Arulmighu Vellangiri Andavar Thirukoil, Poondi, Porur Taluk, Coimbatore. 2. Learned counsel for the petitioner submitted that the shop Nos.1,2,4 and 5 in the premises of Arulmighu Vellangiri Andavar Thirukoil, Poondi, Porur Taluk, Coimbatore were allotted to the petitioner and she has been carrying on business only the items notified in the tender notice. The said shops were leased out to the petitioner upto 30.06.2026. Since the respondents notified some of the shops for public auction to be conducted on 06.06.2026 the petitioner made a representation to the respondents seeking extension of time in respect of shop Nos.1,2,4 and 5. However, without any notice to the petitioner, the impugned order has been passed. Challenging the same, she filed this Writ Petition. 3. Mr.S.Surya, learned Government Advocate, who accepts notice on behalf of the respondents, submitted that the lease period of the petitioner's shops expired on 30.06.2026 and once the lease period expired, the petitioner is supposed to fairly vacate and hand over the premises to the respondents. She cannot expect any notice from the respondents. He further submitted that even though no notice was issued, after providing an opportunity of hearing only the https://www.mhc.tn.gov.in/judis WP No. 31666 of 2026 __________ Page3 of 4 impugned order has been passed. Therefore, he prayed for dismissal of this Writ Petition. 4. At this stage, the learned counsel for the petitioner seeks four weeks time to vacate the shops. 5. Heard the learned counsel on either side and perused the materials available on record. 6. Considering the submission of the learned Counsel for the petitioner and the learned Government Advocate for the respondents and also the fact that the lease period for the shops allotted to the petitioner expired on 30.06.2026, this Court is not inclined to interfere with the impugned order. Accordingly, this Writ Petition is dismissed. However, considering the request of the learned counsel for the petitioner, the petitioner is granted time till 02.09.2026. She has to vacate and hand over the shops to the respondents on 03.09.2026 without fail. In the event if the petitioner pays the rent for the lease period and also for the period beyond the expiry of lease period viz., July and August, 2026, she is eligible to participate in the auction to be conducted by the respondent. No costs.
