In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Surajpal @ Santosh, who has been accused in FIR No.65 of 2026, dated 26.02.2026 under Sections 376, 323, 504 and 506 IPC, at Police Station Transit Camp, District Udham Singh Nagar.
5. As per the prosecution story, the First Information Report was lodged against the present Applicant and other co- accused with the allegation of sexual relationship on false pretext of marriage.

Learned counsel for the Applicant submits that there is a love relationship between the Applicant and the victim and the Applicant has been falsely implicated in the present matter. He further submits that the Applicant has no previous criminal history and the Applicant has been languishing in jail since 16.03.2026.
7. Learned State Counsel has vehemently opposed the
bail application of the Applicant.
8. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
9. Accordingly, bail application is allowed. It is directed that the Applicant - Surajpal @ Santosh, who has been accused in FIR No.65 of 2026, dated 26.02.2026 under Sections 376, 323, 504 and 506 IPC, at Police Station Transit Camp, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
