Petitioners have challenged the order passed by the Deputy Commissioner, Godda dated 20.02.2025 in Misc. Petition No.10 of 2023-24. 3. The dispute relates to right, title and interest over the land in question. The petitioners and the private respondents claim title over the land. The petitioners claim that they have purchased the same from the decedents of the recorded tenant. The private respondents also claim their title. In the earlier round of litigation arising out of W.P.(Cr) No.395 of 2022 a co-ordinate Bench of this Court in order dated 18.07.2023 has held that the High Court sitting under Article 226 & 227 of the Constitution of India is not required to give any finding on the right, title and interest which can be decided by a competent Court of 2026:JHHC:10640 4 Civil Jurisdiction. Thereafter, directed the Deputy Commissioner, Godda to personally supervise the matter and take a decision within a reasonable period of time considering Section 144 of the Cr.P.C. 4. It is the grievance of the petitioner that thereafter the Deputy Commissioner, Godda had passed the impugned order holding that since neither of the parties have proved their title, the land is deemed to have been vested. 5. Learned counsel for the petitioner submits that there is no concept of deemed vesting. He admits that there is nothing on record to suggest that land at all vested by virtue of any notification or by any power conferred by law. It is his contention that he was never issued notice before the impugned order was passed. 6. Learned counsel for the State submits that the impugned order suggest that both the parties could not established their title. It is the petitioners claim that the land has been purchased by them from their vendors, but they could not establish that they were the legal heirs of the recorded tenants and so is the case of the private respondents. 7. Considering the nature of dispute and the arguments laid by the parties, I am of the opinion that this is a case which involves serious disputed question of facts. The claim of right, title and interest needs to be decided. Further, there is claim made by the petitioners and counter claim made by the private respondents. Both of these groups are claiming title over the land in question. These types of issues cannot be decided in an application filed under Article 226 of the Constitution of India, rather, the parties should approach the Civil Court of competent jurisdiction claiming their right, title and interest, thus, I direct the petitioners to approach the Civil Court for grant of right, title and interest over the land in question which will be considered on merits by impleading the private respondents and State as party. Further, the finding of the Deputy Commissioner, Godda in 2026:JHHC:10640 5 order dated 20.02.2025 will not have any effect on the decision which will be decision taken by the Civil Court. If the State claims independent title over the property in question, it will be open to them to initiate an appropriate proceeding or to contest the suit filed by the petitioners. 8.
