Heard Mr. G. Chamuah, learned counsel for the petitioner. Also heard Mr. P.S. Lahkar, the learned Addl. P.P., Assam appearing on behalf of the State respondent.
Page No.# 2/3 This is an application under Section 482 of BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioner, namely, Rukia Ahmed @ Rukiya Khatun, who is apprehending arrest in connection with the Abhayapuri P.S. Case No. 28/2026, registered under Sections 140(3)/309(6)/351(2) of the BNS, 2023. It reveals that the case has already been charge sheeted and the scanned copy of the TCR along with the case diary was called fro from the concerned Trial Court which has accordingly received. It is submitted by Mr. Chamuah, the learned counsel for the petitioner that during the pendency of the present bail petition, the accused petitioner was interim protection and accordingly, appeared before the I.O. and her statement was recorded and thus she cooperated in the investigation of this case. Mr. Lahkar, the learned Addl. P.P., Assam submitted in this regard that from the charge sheet as well as from the case diary, it reveals that the petitioner appeared before the I.O. and her statement was recorded prior to filing of the charge sheet and in the charge sheet also, she is not shown as an absconder and it is also reveals that she was not arrested and on bail as per order of this Court. Considering these aspects of the case and the cooperation extended by the accused petitioner, this Court is of the opinion that the interim bail granted to the present petitioner dated 07.04.2026, can be made absolute with a direction to the present accused petitioner to appear before the learned Trial Court below, with a regular application for bail, which may be considered in accordance with the law.
