It is stated that despite attempts to effect service on the first respondent in the ordinary course, the notice sent to the address furnished by him was returned unserved with the endorsement “No such person found / no such person in the given address”. Thereafter, pursuant to the directions of this Court, notice was also caused to be served on the Trade Mark Attorney/Agent, who had represented the first respondent before the Trade Marks Registry. Despite such service, the first respondent has neither entered appearance nor made any representation in these proceedings. 3. On perusal of the records and the affidavit filed in support of the application, this Court is satisfied that service cannot effectively be completed on the first respondent in the ordinary manner and that substituted service is therefore warranted. https://www.mhc.tn.gov.in/judis
