CRM (M) 604 of 2026
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nowda Police Station Case No. 378 of 2023 dated 30.11.2023 under sections 302 of the Indian Penal Code.
And In the matter of : Biluwara Bibi @ Beluwara Bibi
……Petitioner.
Mr. Md. Golam Nure Imrohi
Mr. Partha Pratim Sinha
……for the Petitioner.
Mr. Sanjay Banerjee
Ms. Suchismita Dutta
……for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 4 months and there is no possibility of the trial being completed in near future. As such, the petitioner may be released on bail. Additionally, it has been contended that the materials, which have surfaced in course of evidence, is cryptic to further detain the petitioner.
Learned advocate for the State opposes the prayer for bail and submits that, out of 16 witnesses cited by the prosecution, 11 witnesses have already been examined and prosecution intends to examine 5 more witnesses in support of its case.
2
I have taken into account the materials appearing in the case diary and having considered the gravity of the offence, I am of the view that, 6 more months be afforded as a last chance to the prosecution to complete its evidence. Accordingly, prosecution would, within a period of 6 months from the next date fixed, complete the examination of the 5 prosecution witnesses.
Petitioner would be at liberty to approach this Court after the said period is over.
At this stage, I am not inclined to release the petitioner on bail.
Accordingly, CRM (M) 604 of 2026 is dismissed.
Learned advocate for the State would communicate this order to the learned Trial Court for necessary action.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
