JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for both the respondents. 2. Learned Counsel for the petitioner submits that proceedings were initiated against the petitioner before the respondent-Assistant Commissioner and the competent authority invoking the provisions of Section 83 of the Karnataka Land Reforms Act, 1961, for violation of the provisions contained in Section 79A and 79B of the Act, in proceedings bearing No.LRF.79(A) and 79(B) 299/2013-14 at Annexure-C and an order was passed by the competent authority dropping the proceedings after accepting the fact that the petitioner belonged to an agricultural family and he had no income in excess of what is provided in the statute and accordingly dropped the proceedings. The name of the petitioner was entered in - 3 - HC-KAR NC: 2026:KHC:11977 WP No. 6229 of 2026 the revenue records. However, one more proceedings were initiated against the petitioner in another case, bearing No.LRF.79(A) and 79(B) 213/2013-14 and the impugned order dated 26.04.2017 at Annexure-A was passed by the respondent-Assistant Commissioner without notice to the petitioner, the impugned order has been passed without noticing the earlier order. 3. This Court has gone through the records and finds that both the proceedings have been initiated in respect of the same transaction dated 11.10.2012 registered as Document No.6653 of 2012-13. Therefore, the learned Counsel for the petitioner is right in the submission that when earlier proceedings have been dropped having accepted the contention of the petitioner, it was impermissible to take up the second proceedings. 4. Accordingly, the writ petition is allowed while qhashing and setting aside the impugned order dated 26.04.2017 at Annexure-A passed by the respondent- - 4 - HC-KAR NC: 2026:KHC:11977 WP No. 6229 of 2026 Assistant Commissioner, Hassan Sub-Division, Hassan in proceedings bearing No.LRF.79(A) & 79(B) 213/2013-14. 5. If the name of the petitioner has been removed from the RTC pursuant to the orders at Annexure-A, the name of the petitioner shall be restored in revenue records, as expeditiously as possible and at any rate within a period of six weeks from the date of receipt of a copy of this order. 6.
