IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 17-08-2026 CORAM THE HONOURABLE MR.JUSTICE P.B. BALAJI CMP No. 8364 of 2026 in CRP SR No.207079 of 2025 1. G.C.Murugan S/o.Chinnathambi, 45, gandhi nagar, L.Kallipatti, Lakkampatti, Gobichettiplayam, Erode District. Petitioner Vs 1. Balachenniappan S/o Kailasam No.45/6, Mettur Thottakadu Thottam, Perumpalayam, Kavunthampadi Village Bhavani Taluk, Erode District Respondent(s) For Appellant(s): P.R.Balasubramanian For Respondent(s): No appearance ORDER The petition is filed to condone the delay of 129 days in filing the revision. 2.Despite service of notice on the respondent and the respondent also choosing to enter appearance through counsel, there is no appearance on behalf of the respondent today. No counter affidavit has also been filed opposing the delay application. 3. I have heard the learned counsel for the petitioner. I have also gone through the affidavit filed in support of the application seeking for condonation of delay. As https://www.mhc.tn.gov.in/judis P.B.BALAJI.,J sr against the decree for recovery of money, the petitioner filed execution petition in EP No.43 of 2020 seeking to recover Rs.29,98,664.50. The Executing Court reserved Orders and in fact, allowed the Execution Petition. However, the petitioner states that he is unaware of the Executing Court reducing the quantum to Rs.8,50,000/- which he came to know only after the order uploaded in the E-courts. Immediately, the petitioner has filed the present revision. However, in the interregnum period, the delay of 129 days has occasioned. The reasons set out in the affidavit filed in support of the petition seeking condonation of delay are acceptable and also bonafide. Accordingly, CMP No.8364 is ordered and the delay is condoned. Registry is directed to number the revision, if it is otherwise in order, and post the revision for admission on 20.8.2026 by printing the name of the respondent 17.08.2026 sr CMP No. 8364 of 2026 in CRP SR No.207079 of 2025 https://www.mhc.tn.gov.in/judis
