The present writ petition has been filed by petitioner seeking a writ of mandamus against respondent Nos.2 and 3 to consider and decide the representation made by petitioner for plucking mangoes from the orchard in Khasra No.414ga, 415kha, 425ka and 426ka of Village Mauja Rolahedi, Paragna and Tehsil Bhagwanpur, District Haridwar.
4. From perusal of record, it transpires that some dispute arose with regard to the aforesaid land, over which the mango orchard was situated.
5. It is the case of petitioner that after losing from all the Forums and Courts, aforesaid land stand vested with the State Government.
6. Since the land has already been vested with the State Government on 16.02.2023, therefore, petitioner has got no concern with the said land. Petitioner does not have any right to even pluck the mangoes, if any, from the aforesaid orchard.
7. It is admitted to petitioner that he has challenged the judgment and order passed
2026:UHC:4230 by the Single Judge in Writ Petition No.3492 of 2023 Levin Kumar Vs. State of Uttarakhand and Another, by filing Special Appeal No.348 of 2025 (Levin Kumar v. State and others) which was dismissed as not pressed vide order dated 16.03.2026 passed by the Division Bench. Petitioner did not put those orders to challenge by filing Special Leave Petition before the Apex Court. Thus, the orders attained finality.
8. In such view of the matter, present writ petition is totally misconceived and the same is accordingly dismissed in-limine.
9. Pending application also stands disposed of.
