The petitioner is apprehending his arrest in connection with Littipara P.S. Case No. 03 of 2026, registered for the offence under Sections 303(2) and 317(2) of Bhartiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development and Regulation) Act, Rule 54 of Jharkhand Minor Minerals Concession Rules, 2004, Rules 7, 9, 13 of Jharkhand Mineral (Prevention of Illegal Mining, Transpiration and Storage) Rule, 2017 pending in the Court of learned Additional Chief Judicial Magistrate, Pakur.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the driver of the truck and the allegations are made of loading 850 CFT of stone chips. He further submits that the petitioner has got no criminal antecedent as disclosed in para 6 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that illegally, the stones chips were being carried.

Considering that the petitioner is the driver of the said truck and he is having no criminal antecedent and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
