For Petitioner(s): Mr.T.Naveen Chandar For Respondent(s): Ms.R.K.Varshini Government Advocate For R1 to R5 https://www.mhc.tn.gov.in/judis WP No. 30815 of 2026 __________ Page3 of 6 Order This writ petition has been filed seeking to direct the respondents to consider the petitioner’s representation dated 15.06.2026 seeking restoration of the petitioner’s name in the revenue records relating to the property comprised in Survey No.127/2B, Kanavenahalli Village, Palacode Taluk, Dharmapuri District. 2.Learned counsel for the petitioner would submit that the petitioner made a representation dated 15.06.2026 seeking restoration of the petitioner’s name in the revenue records relating to the property comprised in Survey No.127/2B, Kanavenahalli Village, Palacode Taluk, Dharmapuri District. Since the same was not considered, the present writ petition has been filed. 3.Learned Government Advocate appearing for the respondents 1 to 5 would submit that the 4th respondent vide order dated 17.02.2026, has rejected the petitioner’s representation citing the reason that the sub-division number was wrongly mentioned. 4.In reply, learned counsel for the petitioner would submit that no notice was issued to the petitioner before rejecting the petitioner’s representation. If opportunity was granted the petitioner would have rectified the error in the sub-division number. 5.Heard the learned counsel for the petitioner as well as the learned Government advocate appearing for the respondents 1 to 5. 6.Considering the submissions made by both parties and upon perusal of the order dated 17.02.2026 makes it clear that the 4th respondent has passed the non-speaking order without affording opportunity to the petitioner. Therefore, the order dated 17.02.2026 passed by the 4th respondent is hereby set aside and the matter is remanded back to the 4th respondent. The 4th respondent is directed to consider the petitioner’s representation dated 15.06.2026, by affording personal hearing opportunity to the petitioner and pass order within a period of four (4) weeks from the date of receipt of a copy of this order. 7.In view of the above, this writ petition is disposed of.
