For the respondents : Mr. Rahul Thakur, Deputy Advocate General. Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has, inter alia, prayed for the following reliefs:- “a. That an appropriate writ, order or direction may kindly be issued and transfer order date 31.3.2026 may kindly be quash and set-aside, whereby the petitioner has been transferred from Sub Division Bhardwad, Sarkaghat, District Mandi to ENC Shimla. 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:14882 b. That an appropriate writ, order or direction may kindly be issued and the respondents may kindly be directed to during the Pendency of the present writ petition, the operation and implementation of transfer order dated 31.03.2026 may kindly be stayed and the respondents may kindly be directed not to relieve the petitioner from his present place of posting. c. Issue a writ in the nature of Mandamus directing the respondents to allow the petitioner to continue at his present place of posting at Sub Division Bhardwad, Sarkaghat, District Mandi.” 2. The petitioner is aggrieved by the fact that in terms of Annexure P-1, dated 31.03.2026, he stands transferred from Sarkaghat Division to the Office of ENC Shimla. The petitioner is serving as a Driver. 3. Learned counsel for the petitioner submitted that the petitioner was posted at Sarkaghat only on 05.12.2024 and thus he has been transferred without permitting him to complete his normal tenure at the said station. 4. On a query put to the learned counsel, he informed the Court that before being posted at Sarkaghat, he has been serving at Baldwara which is in Sarkaghat Division. 3 2026:HHC:14882 5. On the other hand, learned Deputy Advocate General by referring to Annexure P-1 submitted that in light of the fact that there is no work available at the place where the petitioner was posted, the transfer has been made. 6. In light of the respective contentions of the parties, this petition is disposed of without interfering with the transfer order, but with the observation that the petitioner may join at the station to which he stands transferred and after some reasonable time, he may represent to the Authority for his adjustment at some other station and the representation be considered sympathetically by the Authority, in case work is available at the station(s), to which the petitioner seeks transfer. 7.
