Learned counsel for the petitioner submits that the petitioner had instituted a suit for permanent injunction in the year 2014 against the Urban Improvement Trust, Kota, as well as the private respondents, in respect of Plot Nos. 21 to 27 situated at Kota. He further submits that two of the defendants, namely Santosh Dingar and Smt. Raj Kumari Soni, have also filed a separate suit claiming rights over Plot Nos. 24, 25 and 26.

Learned counsel for the petitioner contends that if judgments are delivered in the three suits separately, there exists a possibility of conflicting or contradictory decrees. Therefore, he prays that although the trial Court may proceed with three suits independently but the same Court shall decide the matters on the
[2026:RJ-JP:7927] (2 of 2) [CW-2226/2026] same date, so as to avoid any inconsistency or contradiction in the decrees.

4. This Court deems it appropriate to direct that the trial court may proceed with the suits independently; however, while deciding the three suits filed by Mr. Amit Khandelwal, Smt. Santosh Dhingra, and Smt. Rajkumari Soni, the same shall be adjudicated by the same Court on the same date, so as to avoid any possibility of contradictory judgments or decrees.
5. If the respondents are in any manner aggrieved by this
order, then they are free to approach this Court by filing the recalling application.
6. With the above observations, the present civil writ petition stands disposed of.
7. All pending application(s), if any, stand disposed of.
