1. The petitioner, through the medium of this petition, seeks a direction upon the respondents to release the payment of Rs. 49,00,000/- in favour of the petitioner, along with permissible rate of interest for the work of P/L Premix Carpet on the road from Santra Morh to Rathua Via Govt. Higher Secondary School, Ghomanhasan (under NABARD Scheme) which Serial No. 162

was executed by him in pursuance allotment letter No. 1116-18/SEJ PWD dated 19.05.2017 being undisputed and admitted claim of the petitioner. 2. Learned counsel for the petitioner submits that the petitioner had been allotted work of providing and laying wet Mix Macadam and 50 mm thick Bituminous Macadam and 25 mm thick Open Graded Premix Carpet on road from Santra Morh to Rathua via back side of Government Higher Secondary School at Gho Manhasan including link to Puran De Kothey and Bhagatpur Kukrian to Sandwan (Under NABARD) on 19.05.2017 pursuant to e-NIT No. 01 of 2017-18 dated 10.04.2017 issued vide endorsement No. 71-145 dated 10.04.2017 and corrigendum No. 173-95 dated 12.04.2017, to the satisfaction of the respondents; that as per communication dated 29.01.2026 made by respondent-Executing Engineer, PWD (R&B) Division Bakshi Nagar, Jammu to the petitioner’s counsel in response to the legal notice, admitted that the payment of the subject work has been made to the tune of Rs. 283.00 lacs till date and as per the reproduced CC4th bill the payment amounting to the tune of Rs. 49.01 lacs is still pending. 3. Learned counsel for the petitioner submits that the petitioner shall be satisfied in case the petition is disposed of, at this stage with a direction to the respondents to release the aforestated admitted liability. 4. In view of the pleadings and submissions urged at the bar, particularly in the face of the admission made on the part of the respondent- Executing Engineer, PWD (R&B) Division Bakshi Nagar, Jammu vide communication dated 29.01.2026, the petition is disposed of at this motion stage with a direction to the respondents to make payment of the admitted liability, subject to verification to the petitioner within a period of six months, failing which, the amount shall be payable alongwith interest @ 6
