Order The petitioner, who was arrested and remanded to judicial custody on 23.05.2026 for the alleged offences under Sections 3, 4(2) of POCSO Act, 2012 under Section 66E of IT Act 2008 and under Section 126(2), 87 of BNS in Crime No.36 of 2025 on the file of the respondent police, seeks bail. __________ Page1 of 4 https://www.mhc.tn.gov.in/judis

2. The case of the prosecution is that the petitioner kidnapped the victim, had forcible sexual intercourse with her and took nude photographs of her. Hence the case.
3. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner and the victim girl were in love affair. He would further submit that the petitioner has been in judicial custody since 23.05.2026 and the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and submitted that the statement under Section 183 of BNSS has been recorded.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side.
6. On perusing the statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), this Court finds serious allegations of penetrative sexual assault committed against the victim, who is aged about 15 __________ Page2 of 4 https://www.mhc.tn.gov.in/judis
CRL OP No. 20290 of 2026 years. The petitioner is aged about 28 years and is also a married person. Hence, this Court is not inclined to enlarge the petitioner on bail
