Page No.# 2/2 Though this bail petition was fixed today for case diary, but it is submitted by Mr. Ahmed, the learned counsel for the petitioner that this petition was filed inadvertently seeking anticipatory bail, though the sections under which the case is registered i.e. Sections 137(2) and 127(2) are bailable, as per the BNS, 2023. Accordingly, the learned counsel for the petitioner submitted that he may be permitted to withdraw the present bail petition. Considering the submissions made by the learned counsel for the petitioner and the nature of offence, this Court is of the opinion that the present anticipatory bail petition is not maintainable.
