The learned counsel for the petitioner submitted that the fourth respondent passed the impugned order solely on the ground that a civil suit in O.S. No. 13 of 2021 was pending. However, the said suit has now been decided in favour of the petitioner’s vendor by a judgment and decree dated 19.06.2026. Heard the learned counsel for the petitioner, Ms. Inthu Karunakaran, learned Government Counsel appearing for respondents 1, 3, and 4, and Mr.M.Roshan Atiq, learned Government Counsel appearing for the second respondent. 4. Considering the fact that the suit in O.S. No. 13 of 2021 has been decided in favour of the petitioner’s vendor by the judgment and decree dated 19.06.2026, the impugned order dated 03.01.2026 is set aside. While setting aside the impugned order, this Court grants liberty to the petitioner to file a fresh application before the fourth respondent along with a copy of the judgment and decree passed in O.S. No. 13 of 2021. On such application being filed seeking transfer of patta, the fourth respondent / Tahsildar concerned is directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of six (6) weeks from the date of receipt of the application, after issuing notice to the petitioner as well as any other interested parties and affording them an opportunity of a personal hearing. __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 28044 of 2026 5.
