This appeal is preferred against an order dated 06.12.2022 passed by the Principal District and Sessions Judge at Mysuru in Com.O.S. No. 46/2022 rejecting an application for temporary injunction. 2. We have heard the learned counsel appearing for the appellant and learned counsel appearing for respondents No. 1 and 2. 3. The learned counsel appearing for the respondents submits that after the I.A. was rejected, possession of the - 3 - HC-KAR NC: 2026:KHC:15250-DB COMAP No. 8 of 2023 property was taken over by the respondent and a tender notification was issued on 10.12.2022. It is submitted that license had been cancelled and notice canceling the license was also challenged by the appellant in W.P. No. 3577/2023. The said writ petition was also dismissed. It is also submitted that in the above view of the matter, nothing survives for consideration in this appeal. 4. Having considered the contentions advanced and the submissions made on either side, the appeal is dismissed. The suit shall be proceeded with and decided in accordance with law.
