3. Petitioner has staked claim for appointment as Assistant Teacher against a post reserved for EWS category. According to petitioner, there were four vacancies advertised for the said category and petitioner stands at sl. no. 5 in order of merit amongst EWS category candidates.

Learned counsel for petitioner submits that the candidate, who is placed at sl. no. 1 in that category, possessed the certificate issued from NIOS and her result has been kept in a sealed cover. He submits that the candidate at sl. no. 1 may not be appointed and instead petitioner should be offered appointment as Assistant Teacher.
5. This Court cannot grant the relief as claimed for, since the candidate whose result is kept in a sealed cover is entitled to have her claim considered for appointment as per law.

Learned counsel for the petitioner submits that petitioner has made representation, therefore, the competent authority be asked to take decision on that representation within some

7. The writ petition, however, is
disposed of with a request to the competent authority to examine the claim of the person who stands at sl. no. 1 in merit amongst EWS category candidates, and if she is found ineligible after due inquiry, then consider petitioner’s claim for appointment. However, this Court is not fixing any time limit for taking decision in the matter and the competent authority shall take decision at its own pace, after providing opportunity of hearing to the other candidates.
