For Petitioner(s): Mr.S.S.Swaminathan ORDER This Petition has been filed seeking to set aside the order of dismissal passed on 14.07.2025 in the above CMP No.22901 of 2018 in SA.SR.No.59445 of 2019. 2. This Court, by an order dated 14.07.2025, allowed the petition in C.M.P.No.22901 of 2018 which was filed seeking to condone the delay of 192 days in filing the appeal, on payment of cost of Rs.1,000/- payable in favour of the Cancer Institute (WIA) on or before 24.07.2025. This Court also observed that if the payment was not made within the stipulated time, the condone delay petition would stand automatically dismissed without further reference to the Court. Since payment was not made within the time prescribed by this Court, the petition stood dismissed automatically. Hence, the present petition has been filed. 3. Mr.S.S.Swaminathan, the learned counsel for the petitioner would submit that due to his close relative’s death, he was not able to attend the Court https://www.mhc.tn.gov.in/judis

He would further submit that if a week’s time is granted, the petitioner shall pay the cost of Rs.1,000/- payable in favour of the Cancer Institute (WIA). 4. Accordingly, this petition is allowed and the order passed in CMP No.22901 of 2018 in SA.SR.No.59445 of 2019 on 14.07.2025 is set aside.
