SURENDER WP No. 28652 of 2026 AND WMP NO. 31393 & 31394 OF 2026 Woosu Automotive India Rep. by its Authorized Signatory Mr. Arun Kumar, No.130, Narasingapuram Village, Perambakkam Post, Tiruvallur -631 402 ..Petitioner(s) Vs G.Selvam ..Respondent(s) Writ Petition filed under Article 226 of Constitution of India seeking Writ of Certiorari to call for the records of the impugned order dated 06.04.2026 in I.D. No.177/2015 passed by the II Additional Labour Court, at Chennai and quash the same. For Petitioner(s): M/s.R.Ganesan For Respondent(s): ORDER The Writ Petition has been filed challenging the order dated 06.04.2026 in I.D.No.177 of 2015 passed by the II Additional Labour Court, Chennai. 2. The petitioner company is engaged in the manufacture of automotive components. The respondent, along with 58 similarly placed persons, raised an industrial dispute in I.D. No. 177 of 2015 before the II Additional Labour Court, Chennai, seeking reinstatement with continuity of service, back wages, and other attendant benefits. According to the petitioner, the respondent was merely a trainee/contract labourer engaged through an independent contractor, and no employer-employee relationship existed between the parties. The petitioner further contends that disciplinary proceedings were initiated against the respondent for acts of misconduct, a domestic enquiry was conducted in accordance with the law, the charges were proved, and consequently, the respondent was dismissed from service on 06.01.2014. By an order dated 06.04.2026 in I.A. No. 8 of 2023, the Labour Court held that the domestic enquiry was not fair and proper. Challenging the said order on the grounds that it was passed ex parte, without affording adequate opportunity to the Management, and contrary to the evidence and settled principles governing domestic enquiries, the present Writ Petition has been filed. 4. This Court, while dealing with similar issues by an order dated 02.06.2026 in W.P. Nos. 19064, 19076 & 19082 of 2026, held as follows: “8. As already discussed above, the said argument is https://www.mhc.tn.gov.in/judis WP No. 28652 of 2026 __________ Page3 of 4 incorrect, as several opportunities were, in fact, granted by the Labour Court to the Management to adduce evidence. The I.D. case was filed in the year 2015. Having attended the case from the inception and also approaching this Court by way of filing writ petitions, the petitioner’s claim that no opportunity was given to examine witnesses or record evidence on behalf of the Management is deliberately and palpably wrong, intended solely to protract the proceedings. 9. The case has been pending before the Labour Court for a period of 11 years. This Court, under Article 226 of the Constitution of India, can interfere only if there is a violation of the Principles of Natural Justice or if the impugned order is passed contrary to the law. No such grounds have been made out to warrant interference with the impugned order. 10.Accordingly, the writ petitions stand dismissed…” 4. In view of the above, the present Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 29-07-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JAI https://www.mhc.tn.gov.in/judis WP No. 28652 of 2026 __________ Page4 of 4 K.SURENDER J.
