3. By the instant petition, the petitioner is challenging the order dated 05.07.2025 passed by learned District Judge, Champawat, in Misc. Civil Appeal No. 10 of 2024 whereby temporary injunction as sought by the plaintiff before the trial court was granted at the appellate stage, which was rejected by the trial court on 23.09.2024 against which plaintiff preferred the aforesaid appeal and interim injunction was granted.
4. By order impugned temporary injunction has been granted through the original suit filed by the plaintiff for permanent injunction is still pending.

Learned counsel for the both the parties submits that the suit be expedited and till then, order passed by the learned District Judge, Champawat dated 05.07.2025 passed by Civil Appeal No. 10 of 2024 be modified by the directing the both parties to maintain the status quo.

In such view of the matter, the instant writ petition is disposed of finally with the direction to the learned Civil Judge (JD), Tanakpur, to expedite the proceeding of Original Suit No. 08 of 2021 (Paras Vs. Harsh Kumar and another) preferably within six month from the date of presentation of the certified copy of this order.
7. It is made clear that till the suit is expedited,
order passed by the learned District Judge, Champawat dated 05.07.2025 passed by Misc. Civil Appeal No. 10 of 2024 is modified to this extent that both the parties shall maintain the status quo, over the property in question.
