Mr.B.Pachaiyappan, learned Government's counsel, takes notice on behalf of the respondents. 3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself. 4. The learned counsel for the petitioner would submit that in this case, survey was already conducted at the subject land on 10.06.2026. However, the boundaries were not earmarked. Hence, a fresh application was made for conducting re-survey at the subject land by using DGPS method. However, the said representation was not at all considered by the respondents till date. Hence, this petition. 5. In reply, the learned counsel for the respondent would submit that the petitioner’s representation will be disposed of within a period of 2 weeks and hence, he requests this Court to pass appropriate orders. https://www.mhc.tn.gov.in/judis

6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record. 7. In the case on hand, survey was already conducted at the subject land on 10.06.2026. However, the boundaries were not earmarked.
Hence, a fresh representation was made for conducting re-survey at the subject land by using DGPS method. Normally, this Court will not entertain any petition, filed for a direction to re-survey the subject land. However, in this case, though the survey was conducted, no boundary stones were laid at the subject land. In such case, this Court is inclined to issue a direction to re-survey the said property. 8. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the 1st & 2nd respondents to consider the representation of the petitioner dated 06.07.2026 and after issuing notice to all the concerned parties, including the adjacent land owners, dispose of the same, on merits and in accordance with law, within a period of 2 weeks from the date of receipt of a copy of this order and thereafter, conduct re-survey at the subject property, preferably by way of DGPS (Differential Global Positioning System). After the completion of survey, the official respondents shall lay the boundary stones and provide the coordinates to the petitioner. WP No. 30094 of 2026 __________ Page4 of 6 encroachment by the 3rd parties at the subject land, it is up to the petitioner to remove them. 8. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent for conducting survey and laying boundary stones at the subject land. If there is any dispute with regard to the title/possession over the said property, the same has to be decided only by way of filing a suit before an appropriate Civil Court. 9. If any police protection is required at the time of conducting survey, the revenue officials are granted liberty to avail the same by approaching the jurisdictional police station. In such case, the concerned police officer shall provide all necessary protection to the revenue officials till the completion of survey at the subject land.
