Side) for R1 ORDER This Criminal Original Petition seeks to quash the FIR in Crime No.27 of 2026 on the file of the 1st respondent Police for the alleged offences under Sections 498(A), 294(b) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women (Amendment) Act, 2002, on the ground of compromise between the husband and wife, as they decided to separate amicably. 2. The Hon’ble Supreme Court of India in B.S. Joshi and others -Vs- State of Haryana and Another (2003 4 SCC 675) and subsequent judgments had held that non-compoundable cases arising out of marital discord can be quashed by exercising the powers under Section 482 Cr.P.C./528 BNSS on compromise between the parties if the husband and wife join together or separate amicably. 3. Accordingly, this Crl.O.P. No.19785 of 2026 stands allowed.
