In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Rahul Kumar, who has been accused in FIR No.98 of 2025, under Sections 305a, 331 (4) and 317 (2) of Bharatiya Nyaya Sanhita, 2023, at Police Station Sitarganj, District Udham Singh Nagar. 4. As per the case of the prosecution that one Vikrant Mishra, went with his family to take a bath in the Ganga at Kumbh Mela, from where he returned. When he returned from Katra to home in Pahadi Ukrauli, SIDCUL, Sitarganj, I and my family found the locks of my house broken, all the belongings scattered, and gold and silver jewellery and cash kept in the cupboards were stolen. Today, we inquired with our neighbours, and they informed us that a few days ago, Anil, a resident of the neighbourhood, and his friends were roaming around your house. I suspect they may have committed the theft at my house. 5. Learned counsel appearing on behalf of the Applicant submits that the Applicant has been falsely implicated in the present matter, and the Applicant is not named in the FIR. He further submits that there is a delay in lodging the FIR. 6. Learned State Counsel has vehemently opposed the bail application of the Applicant. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Rahul Kumar, who has been accused in FIR No.98 of 2025, under Sections 305a, 331 (4) and 317 (2) of Bharatiya Nyaya Sanhita, 2023, at Police Station Sitarganj, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
