PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 483(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to modify the bail condition imposed against the petitioners/ Accused Nos.1 to 4 vide order dated 12.06.2026 in Crl.M.P.No.56 of 2026 arising out Crime No.578 of 2025 of Patamata Police Station, passed by the leaned Principal District and Sessions Judge, Krishna, Machilipatnam. 2. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. The learned Principal District and Sessions Judge, Krishna, Machilipatnam, vide order dated 12.06.2026 in Crl.M.P.No.56 of 2026 arising out Crime No.578 of 2025 of Patamata Police Station while enlarging the petitioners/ Accused Nos.1 to 4 on bail, imposed a condition that the petitioners shall produce atleast one local surety each. Insisting to produce the local sureties is against the judgment of the Hon’ble Apex Court in Moti Ram vs. State of Madhya Pradesh 1 and Satender Kumar Antil vs. Central Bureau of Investigation and another2. 4. Hence, in the order dated 12.06.2026, condition No.(b) is hereby relaxed and condition No.(c) is modified as: "The Petitioners/Accused Nos.1 to 4 shall appear before the Station House Officer, Patamata Police Station, every day." 5.
