For Petitioner(s): Mr. S.Sivaskandavarman For Respondent(s): Ms.N.Karpagalakshmi For R.Balaji Order This Writ Petition has been filed seeking a direction to the respondent to revise the petitioners pay in accordance with the 15th wage settlement dated 29.05.2025, with retrospective effect from 01.09.2023, and Consequently re- compute and disburse the differential amounts payable towards Provident Fund, Earned Leave Encashment, Gratuity, Pensionary Benefits and all other Consequential terminal and retirement benefits based on the revised last drawn wages, together with applicable interest, within such time as may be fixed by this court. 2. The petitioner was appointed on 18.11.1989 in the respondent- Corporation and he retired from service as a Senior Assistant Staff on 31.01.2025, prior to the wage settlement entered into a settlement under Section 12(3) of the Industrial Disputes Act, 1947 was arrived at on 29.05.2025 and was given retrospective effect from 01.09.2023. However, his terminal benefits were settled on the basis of the pre- revised pay instead of the revised pay. Consequently, the petitioner is entitled to the differential amounts towards leave salary, gratuity and pension arrears.
Though the petitioner submitted a representation dated 02.07.2026 in this regard to the respondent, the same has not been considered. Hence, the petitioner has come up with the present writ petition. 3. The learned Standing Counsel for the respondent would fairly submit that they are willing to pay the applicable differential amounts payable towards Provident Fund, Earned Leave Encashment, Gratuity, Pensionary Benefits and all other Consequential terminal and retirement benefits in accordance with the 15th Wage Settlement dated 29.05.2025. 4. Heard the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondent corporation. 5. In view of the above submission of the learned Standing Counsel appearing on behalf of respondents, this Court deems it appropriate to direct the respondent to revise the pay scale of the petitioner as per the 15th wage https://www.mhc.tn.gov.in/judis
WP No. 28927 of 2026 __________ Page4 of 5 settlement and pay the applicable differential amount payable towards Provident Fund, Earned Leave Encashment, Gratuity, Pensionary Benefits and all other consequential terminal and retirement benefits to the petitioner, in accordance with the 15th Wage Settlement dated 29.05.2025 together with 6% per annum from the date on which the amounts became due till the date of actual payment. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. 6. Accordingly, this Writ Petition is disposed of with the aforesaid direction.
