1. Heard Ms. T. Som, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of F. C. (Criminal) Case No.18/2020, pending in the Court of the learned
Page No.# 2/2 Principal Judge, Family Court, Barpeta.
3. Considering the pendency of the case before the Family Court, Barpeta, another case was registered against the present petitioner Shaizuddin. For that matter, he was on the run from being arrested by Police. This is the reason why he could not appear before the Family Court, Barpeta to contest the case and the learned Principal Judge, Family Court, Barpeta directed issue of NBWA against the present petitioner Shaizuddin.
4. The petitioner submits that he is now free to contest the case before the Trial Court.
5. I have considered the submissions made by the learned counsel for both sides.
6. Considering the submissions made by learned counsel for both the sides, this Court is of the opinion that all orders directing issue of NBWA against the present petitioner, Shaizuddin by the learned Principal Judge, Family Court, Barpeta in F. C. (Criminal) Case No.18/2020 are set aside.
7. The petitioner, Shaizuddin is allowed to remain on previous bail.
8. With the aforesaid direction, this criminal petition stands disposed of.
