By way of this petition, the petitioners have prayed for the following reliefs : 10.1 That, this Hon'ble Court may kindly be pleased to call for entire records of the case, from the respondent authorities. 10.2 That, this Hon'ble Court may kindly be pleased to quash the order dated 31.12.2020 passed by respondent no. 3 for allotment of the Fair Price Shop Kotetara, Ditrict Janjgir- Champa (C.G.) (Annexure- P/1) and further be please to direct to the respondent authority to made allotment of the said shop in favour of petitioners. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given. 2. Learned counsel for the petitioners submits that by efflux of time, this petition has rendered infructuous. However, he submits that since the subject application remained pending for a considerable period and was not decided, the petitioners may be granted liberty to approach the concerned authority i.e. the concerned Collector 3 by filing a fresh application, with a direction to the said authority to decide the same within a prescribed time frame. 3. In light of the aforesaid facts, it is directed that if the petitioners file a fresh application before the concerned Collector, the said authority shall decide the same within a period of 45 days from the date of receipt of a copy of this order. 4. At this stage, learned counsel for the petitioners submits that previously also, the petitioners had filed an application before the concerned Collector, however, the said authority did not decide the same and instead allotted the shop to the other party, despite an order of status quo having been passed by this Court on that very date. 5. Admittedly, a single group cannot be granted a Fair Price Shop for a considerably long period. Accordingly, it is observed that while deciding the application, if any, filed by the petitioners afresh, the concerned authority shall keep this aspect in mind and thereafter, pass an appropriate order. 6.
