For Petitioner(s): Mr.V.Ramamurthy For Respondent(s): Mr.N.P.Kumar Special Public Prosecutor for Customs Act (Appeared through Video Conferencing) 1 https://www.mhc.tn.gov.in/judis CRL MP No. 11663 of 2026 ORDER This Criminal Miscellaneous Petition has been filed seeking modification of the conditions imposed in para 5(ii) of Crl.MP.No.16707 of 2024 dated 09.12.2024, and to permit the petitioner to avail himself for hearing as and when directed by the Court. 2. The petitioner/accused in C.C.No.06 of 2021 was convicted by the learned Special Judge, I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai, vide order dated 22.08.2023. Aggrieved by the said judgment, the appellant preferred Crl.A.No.1007 of 2023 and also filed Crl.M.P.No.14694 of 2023, seeking suspension of sentence. 3. This Court vide order dated 10.06.2024, suspended the sentence and granted bail to the petitioner/appellant. One of the conditions was that the petitioner shall report before the Deputy Commissioner of Customs, Kakinada on the first working day of every Monday and Friday at 10.00 a.m., pending disposal of the appeal. 4. Thereafter, the petitioner has filed Crl.M.P.No.16707 of 2024 in Crl.M.P.No.14694 of 2023 in Crl.A.No.1007 of 2023, this Court, by order dated 09.12.2024, modified the conditions as follows: 2 https://www.mhc.tn.gov.in/judis CRL MP No. 11663 of 2026 (i) the petitioner shall appear before the trial Court, once in three months, i.e., first working day of January 2025, April 2025, July 2025 and October 2025. (ii) the petitioner shall appear before the Deputy Commissioner of Customs, Bhimavaram at 10.30. a.m., on the first and third Monday of every month, until further orders. 5. The learned counsel for the petitioner submitted that the petitioner was granted bail on 10.06.2024, and for the past two years, he has been regularly complying with the condition imposed on the petitioner before this Court in Crl.M.P.No.16707 of 2024 dated 09.12.2024 by appearing before the Deputy Commissioner of Customs, Bhimavaram as well as before the trial Court. Hence, he filed the present petition seeking modification of the condition imposed in para 5(ii) of Crl.M.P.No.16707 of 2024 dated 09.12.2024, and to permit the petitioner to appear for hearings as and when directed by the Court. 6. The learned Special Public Prosecutor for the respondent appeared through video conferencing, and submitted that the respondent has no objection to the petitioner’s request to report before the Office of Superintendent of Central Excise & Customs, II Floor, Lakshmi Plaza, Town Hall Road, Bhimavaram, every month, as it would not cause any hardship to the petitioner. 3 https://www.mhc.tn.gov.in/judis CRL MP No. 11663 of 2026 7. Considering the above submissions made by the learned Special Public Prosecutor for the respondent, the request made by the petitioner, and upon perusal of the materials available on record, this Court is inclined to modify the condition as follows: (i)the petitioner shall appear before the Superintendent of Central Excise and Customs, II Floor, Lakshmi Plaza, Town Hall Road, Bhimavaram, at 10.30 a.m., once in every two months, without fail, until further orders. 8.
