ORDER This writ petition is filed challenging the impugned Refusal Check Slip in RFL/Kunnathur/10/2026 dated 18.06.2026 issued by the 3rd Respondent. The petitioner further seeks direction to the 3rd Respondent to accept and register the Partition deed dated 16.06.2026 presented by the petitioner. 2. The impugned Refusal Slip was issued for the following two reasons:- (i) The Will was unregistered. The claim was made under the unregistered Will; (2) Proper stamp duty was not paid. 3. Learned counsel for the petitioner submits that Registration of the Will is not mandatory therefore, the issuance of refusal slip on such ground is not sustainable. As far as stamp duty is concerned, the petitioner will comply with the shortfall of stamp duty. 4. The learned Government counsel submits that as per the settled legal position, registration of Will is not mandatory and therefore, if proper stamp https://www.mhc.tn.gov.in/judis WP No. 28105 of 2026 __________ Page3 of 4 duty is paid, there will no impediment in registering the document, upon representing the document. 5. As rightly contended by the learned counsel for the petitioner as well as the Government counsel, it is not mandatory for a Will to be registered. Therefore, the refusal slip issued on the said ground is not sustainable. Accordingly, the impugned refusal slip dated 18.06.2026 is hereby set aside. The petitioner is directed to represent the document by paying appropriate stamp duty. Upon such representation, the 3rd respondent is directed to register the document in accordance with law. 6.
