Side) https://www.mhc.tn.gov.in/judis CRL OP No. 19801 of 2026 __________ Page2 of 4 ORDER The prayer in the Criminal Original Petition is to quash the proceedings in C.C.No.221 of 2026 on the file of the learned Additional District Judge/Presiding Officer, Special Court for EC and NDPS Act Cases, Coimbatore. 2. On perusal of the records, it can be seen that there are two accused, the petitioner is the Accused No.2 and, both the accused were found to be in possession of four packets containing 2.250 grams of Methamphetamine and as such the case was registered and now investigation is completed and the final report is filed. 3. The foremost contention of the learned counsel for the petitioner is that the recovery was made only from the first accused and the petitioner was only accompanying the first accused. The second contention is that there is delay in analysing the sample. 4. When the case of the prosecution is as if the both the accused together were possessing the contraband and therefore, the submission made by the learned counsel is factual in nature to be taken only during the course of the trial. Similarly, even with reference to the delay in analysis are all points for trial and cannot be taken to be the sole factor for quashing the case. https://www.mhc.tn.gov.in/judis CRL OP No. 19801 of 2026 __________ Page3 of 4 5. In view thereof, keeping open the liberty of the petitioner to raise all the grounds during the course of the trial, the Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
