Heard the parties.
This Criminal Miscellaneous Petition has been filed by the petitioners with the prayer for modification of the order dated 08.09.2023 passed in A.B.A. No.6383 of 2023.
Learned counsel for the petitioners submits that vide order dated 08.09.2023 passed in A.B.A. No.6383 of 2023, the petitioners were given the privileges of anticipatory bail and directed to surrender before the court below within eight weeks from the date of that order upon either satisfying the court concerned that Rs. 1,21,000/- has already been paid by the co-accused, Mukesh Kumar Singh after institution of this case or on depositing Rs. 1,21,000/- jointly by the petitioners by way of demand draft drawn in favour of informant without prejudice to their defence. It is next submitted that though Mukesh Kumar Singh has already returned the said amount to the petitioners but the petitioners had no knowledge about it and when the petitioners came to know about the fact, the stipulated time to surrender before the court concerned had
already lapsed. It is further submitted that now the petitioners are ready and willing to surrender before the learned court below and unless six weeks’ extension is granted to them, they will be highly prejudiced. Hence, it is submitted that the time period for the petitioners to surrender before the court below in terms of the order dated 08.09.2023 passed in A.B.A. No.6383 of 2023 be extended by six weeks from the date of this order.
Considering the aforesaid submission of the learned counsel for the petitioners, the prayer for extension of time for the petitioners to surrender in the court below in terms of the order dated 08.09.2023 passed in A.B.A. No.6383 of 2023 is allowed. Accordingly, the order dated 08.09.2023 passed in A.B.A. No.6383 of 2023 is modified by directing the petitioners to surrender within six weeks from the date of this order in terms of the order dated 08.09.2023 passed in A.B.A. No.6383 of 2023.
The order dated 08.09.2023 passed in A.B.A. No.6383 of 2023 is modified to the aforesaid extent only.
This Criminal Miscellaneous Petition is disposed of accordingly.
