Order The petitioner, who was arrested and remanded to judicial custody on 08.06.2026 for the alleged offences under Sections 126(2), 296(b), 115(2), 311, 351(3) of BNS and 4 of TNPWH ACT in Crime No.280 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant is the elder sister of the petitioner's wife. Due to a family dispute, the petitioner abused and __________ Page1 of 4 https://www.mhc.tn.gov.in/judis
CRL OP No. 20280 of 2026 assaulted the defacto complainant, extorted a sum of Rs.250 from her and threatened her with dire consequences.
3. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in judicial custody since 08.06.2026 and the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and on instructions, submitted that the petitioner has 31 previous cases, including three cases under Section 302 of the IPC.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side.
6. Considering the serious allegation against this petitioner and also upon the fact that the petitioner has 31 previous cases, including three cases under Section 302 of the IPC, this Court is not inclined to enlarge the petitioner on bail. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis
