For Petitioner(s): Ms.Annamma K https://www.mhc.tn.gov.in/judis CRP No. 4337 of 2026 For Respondent(s): Mr.V.Balakrishnan Govt.Advocate For R16 to R19 and R25 ORDER This Civil Revision Petition has been filed, challenging the impugned order dated 04.02.2026 passed by the IV Additional District Munsif Court, Salem in I.A. No. 2 of 2023 in O.S. No. 506 of 2015. 2. The petitioners are the plaintiffs in the suit O.S. No. 506 of 2015 pending on the file of the IV Additional District Munsif Court, Salem. The suit has been filed for declaration and permanent injunction. 3. In the aforesaid order, the application filed by the petitioners, seeking to implead the proposed parties, who are the authorized officers of the UCO Bank, as party defendants in the suit, has been dismissed. 4. The trial Court, while dismissing the application, has held that since there is no dispute with regard to the auction sale made in favour of the second plaintiff and that subsequent to the purchase, the second plaintiff has sold 25,807 sq. ft. of land in favour of the defendants 2 to 15 through sale deed dated 06.02.2013, has held that there exists no connection between the disputed sale deed, and the proposed parties, who are sought to be impleaded by the https://www.mhc.tn.gov.in/judis CRP No. 4337 of 2026 petitioners/plaintiffs. 5. The trial Court has held that the suit can be effectively disposed of without the presence of the proposed parties in the suit. Therefore, the trial Court held that the proposed parties 1 to 5 are neither necessary parties nor proper parties to the suit. 6. This Court does not find any infirmity in the reasons given by the trial Court for dismissing the petitioners’ application. 7. Apart from the said reason, this Court has also taken into consideration the fact that the suit was filed in the year 2015 itself. The very same cause of action, namely to implead the proposed parties as defendants in the suit, arose even at the time when the suit was filed. However, the petitioners have filed the application, seeking to implead the proposed parties only in the year 2023 through I.A. No. 2 of 2023. Therefore, even on the ground of delay and laches, the application, namely I.A. No. 2 of 2023, seeking to implead the proposed parties cannot be entertained. https://www.mhc.tn.gov.in/judis CRP No. 4337 of 2026 8. For the foregoing reasons, this Court does not find any infirmity in the reasons given by the trial court for dismissing the application. Accordingly, this civil revision petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 9. Since the suit is pending from 2015 onwards, the trial Court, namely the IV Additional District Munsif Court, Salem, is directed to dispose of the suit, O.S.
