ORDER:
This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer:
“…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent authorities in preparing the list of beneficiaries for allotment of house sites in the government land in R.S.No. 238/1A situated at Kaikaram village, Unguturu Mandal, West Godavari District, without issuing the Patta certificates to the petitioners pursuant to the Lr.No.7033/2008/E dt. 22-10-2008 issued by the then District Collector, W.G.District, as being illegal, arbitrary and unconstitutional and consequently direct the respondent authorities to issue the house pattas to the petitioners in compliance of the Lr.No. 7033/2008/E dt. 22-10- 2008 on par with the list of beneficiaries prepared by the 4th respondent, and to grant…”
2. The petitioners herein are houseless poor persons and are eking out their livelihood by doing daily wage coolie works. As such, the petitioners have submitted a representation to the Revenue officials for issuing house site pattas in the Government land in R.S.No.238/1A situated at Kaikaram village, Unguturu mandal, West Godavari district, however, the same was not considered by the respondent authorities. 3. While the matter stood thus, in the year 2008, the Government introduced various housing schemes including Indiramma Housing scheme and during implementation of the said scheme, the concerned

authorities conducted a socio-economic survey to identify the eligible beneficiaries and found the petitioners as beneficiaries of the said scheme, however, due to non-availability of the house site pattas, the then District Collector, A.P. Housing Corporation vide letter bearing No.7033/2008/E, dated 22.10.2008 recommended the revenue officials for issuance of house site pattas to the petitioners. In spite of identifying the petitioners as beneficiaries, the respondent authorities, without issuing house site pattas to the petitioners, are preparing a fresh list of beneficiaries for allotment of house sites in favour of some third parties. Aggrieved by such action of the respondent authorities, the petitioners filed the present petition. 4. The 4th respondent filed a detailed counter affidavit duly admitting the facts as stated by the petitioners and further stated that an extent of Acs.12.64 cents in R.S.Nos.236, 237, 238 and 239 of Government land is available in Kaikaram village, Unguturu mandal for distribution of house site pattas to the houseless poor people.
The leveling was completed in May 2016 under Neeru Chettu Programme and the said extent of land is kept vacant till issuance of house site pattas i.e.,
29.07.2018. It is further stated that the applications were called for through „Janma Bhoomi‟ and „Meekosam‟ programmes from the Kaikaram village of Unguturu mandal from landless poor persons for allotment of

house site pattas and pursuant to the same, 656 applications were received by May, 2018, out of which, 466 applications were found to be eligible applications and the same was published in Gram Panchayat, Kaikaram in three spells i.e., on 17.01.2018, 07.06.2018 and 12.06.2018 calling for objections. As no objections were received, including the petitioners, 427 eligible applications were finalized for distribution of house site pattas in Kaikaram village in the „Grama Darshini Programme‟ scheduled on 29.07.2018 and accordingly, 427 house site pattas were issued to the beneficiaries. 5. It is further stated in the counter affidavit that after verifying the case of the petitioners herein, they found that petitioner Nos.1 to 17 alone have requested the Tahsildar, Ungutur through representation dated 04.06.2018 for grant of house sites; that the case of petitioner No.18 was considered and a house site pattas was granted to him; with regard to petitioner Nos.19 and 20, it is stated that they have not submitted any representation for grant of house site though they are found eligible vide letter bearing No.7033/2008/E, dated 22.10.2008 of the then District Collector (Housing), West Godavari District, Eluru. As the petitioners kept quiet without placing their grievance before the respondent authorities till finalization of 427 eligible houseless poor beneficiaries in Kaikaram village of Unguturu mandal for provision of house sites, there is no possibility to

grant house sites to the petitioners, however, their request will be considered for grant of house sites only in further acquisition of land in Kaikaram village of Unguturu mandal.
In view of the same, requested to dismiss the writ petition. 6. Perused the entire material available on record. The facts of the writ petition are not in dispute. Today, when the writ petition came up for hearing, learned Assistant Government Pleader for Revenue furnished a copy of instructions of the 4th respondent bearing Roc.No.289/2026/SA, dated 14.07.2026 wherein it is stated that after conducting detailed enquiry with regard to the facts of the case, it was revealed that petitioner NOs.1, 2, 8, 9, 15 and 18 were provided house sites during „Pedalandariki Illu‟ housing programme in the year 2020 and that the petitioner Nos.4, 14 and 20 were also provided house site pattas but were not given possession due to pending of court cases against such land. The petitioner Nos.5, 6, 11, 12 and 13 possess own houses in Kaikaram village and petitioner No.10 is a Government employee, as such, they are not entitled for any house site patta. With regard to other petitioners i.e., petitioner Nos.3, 7, 16, 17 and 19, it is stated that house sites will be provided as and when land acquisition takes place. 7. In view of the fact that petitioner Nos.1, 2, 4, 8, 9, 14, 15, 18 and 20 were issued house sites during „Pedalandariki Illu‟ housing

scheme and as petitioner Nos.5, 6, 10, 11, 12 and 13 are not entitled for house site pattas, instead of keeping the writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing the respondent authorities to grant house site pattas to petitioner Nos.3, 7, 16, 17 and 19 as and when the respondents initiate land acquisition proceedings for allotment of house site pattas to the land less poor persons, in accordance with law. 8. Accordingly, with the above direction, this writ petition is
disposed of. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this Petition shall stand closed. _____________________
