When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) submitted that the FIR was initially registered under Sections 296(b), 115(2), 351(3), and 74 of BNS, but the offences were subsequently altered to Section 296(b) of the BNS alone. Since the altered offence is bailable in nature, this application for anticipatory bail is not maintainable. Taking cognizance of the alteration report, this Criminal Original Petition is disposed of since the offence charged against the petitioner is bailable offence. 3.
