Order No.
ORDER 10.03.2026
01.
1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Cyber Crime PS North-East Division Yelahanka, Bengaluru P.S. Case No.604 of 2025 pending in the court of learned 45th ACJM Court, Bengaluru City, Bangalore on the grounds stated.
3. Perused the FIR as at Annexure-1. The petitioner has been summoned by the Commissioner of Police of Bengaluru City as per Annexure-2 in terms of Section 35(3) BNSS.
Learned counsel for the petitioner submits that the petitioner is to respond to Annexure-2 but he should be granted transit bail in terms of the Apex Court decision in Priya Indoria Vrs. State of Karnataka and others (2024) 4 SCC 749. The contention is that the petitioner has been issued with such a notice vide Annexure-2 for having received transfer of money in his account and as such, not directly involved in the p. 2 cheating, for which, the FIR as at Annexure-1 is lodged. Considering the submission as above and response of the State, this Court is inclined to grant transit pre-arrest bail to the petitioner so as to enable him to respond to the notice i.e. Annexure-2.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction that the petitioner shall be on transit anticipatory bail for a period of four weeks and in the meantime, to attend the PS concerned in response to Annexure-2 and to co-operate in the investigation without default.
6. Issue urgent certified copy of this order as per rules.
