ORDER: (Per Hon’ble Sri Justice D.Ramesh) The Civil Miscellaneous Appeal is filed aggrieved by the order passed in H.M.O.P.No.179/2008 dated 30.3.2011 on the file of the learned Principal Senior Civil Judge, Tenali. A perusal of the docket shows on many occasions, the matter has been adjourned at the request of the learned counsel for the appellant for getting instructions. Still the counsel is not able to place any fresh instructions. As the appeal is filed against the dismissal of the H.M.O.P. filed under Order 13(1)(ia)&(ib) of H.M.Act and the O.P. is itself of the year 2008, even after lapse of approximately 20 years, no instructions from the appellant. Considering the same, the appeal is dismissed for non- prosecution giving liberty that if parties intend to agitate their rights, they can file an application for restoration and if any application is filed for restoration, the same may be considered. No costs.
As a sequel thereto, interlocutory applications pending, if any, in the writ petition, shall also stand closed.
