For Petitioner(s): Mr.S.Kuberan for Mr.V.Anandhamoorthy For Respondent(s): Mr.L.Mouli for R1 & R2 ORDER This Petition has been filed to Condone the delay of 44 days in filing the above Second Appeal. https://www.mhc.tn.gov.in/judis C.M.P.No.16961 of 2026 2. Mr.L.Mouli has entered appearance for the respondents 1 and 2. He reports that the third respondent, Subbammal, passed away on 09.03.2026. 3. A perusal of the Trial Court records shows that the suit had been presented by one Badrappan, who passed away pending the litigation. Respondents 1 to 3 were brought on record as his legal representatives, pursuant to the order dated 22.09.2021 made in I.A.No.04 of 2021. Since the legal representatives of the deceased third respondent are already on record, there is no necessity for the petitioner to take separate steps for the deceased. The delay is only 44 days. 4. Mr.L.Mouli, does not seriously oppose the petition. 5. Being satisfied with the reasons stated in the affidavit, I find sufficient cause to condone the delay. Accordingly, the petition is allowed 6. Mr.S.Kuberan shall serve the entire set of papers on Mr.L.Mouli. 31-07-2026 VKR Note: Registry is directed to number the appeal, if it is otherwise in order and to print the name of Mr.L.Mouli as the counsel for the respondents in the cause list, when the second appeal is listed. https://www.mhc.tn.gov.in/judis C.M.P.No.16961 of 2026 V.LAKSHMINARAYANAN, J.
