1. The writ petition is under Article 226 of the Constitution of India seeking therein the following reliefs :- 1) That this is an application for quashing of the resolution as contained in Memo No.3027/Ranchi dated 14.12.2015 issued by the respondent no.2 by

which untrained Teachers have been ordered to be given Grade-I from the date of their respective appointment, which provides for matric trained teachers and has further been ordered to be included in gradation list accordingly by way of publishing a fresh gradation list, by issuing an appropriate writ and further for issuance of an appropriate writ/writs, directing the respondents direction/directions not to disturb/modify the gradation list which has been prepared and approved upto 2009 and further to give all such promoting benefits to the petitioners for which they are entitled to over the untrained Matric holder teachers.”

Learned counsel appearing for the State has submitted that in pursuance to the order passed by the Division Bench of this Court in L.P.A. No. 482 of 2023 and L.P.A. No.478 of 2023, fresh list has been published sometime in the year 2025.
3. It has been submitted that even if the relief which is being sought for, i.e., quashing of the Annexure-I, will granted, then also the writ petitioner will have no benefit since he will have to ultimately challenge the fresh seniority list.
4. Upon this, learned counsel appearing for the petitioner has submitted that he is not pressing the instant writ petition, however, has sought for liberty to challenge the fresh seniority list and other consequential relief, if any, before appropriate forum.

5. The instant writ petition, therefore, is allowed to be withdrawn and, as such, disposed of with the liberty to the writ petitioner to challenge the seniority list, if the petitioner so wishes, before the appropriate forum along with the consequential relief, if any.
6. The instant writ petition stands disposed of with the aforesaid liberty.
