JUDGMENT (Judgment of the Court was made by N.Sathish Kumar J.) Today, when the matter is taken up for hearing, both the learned counsel appearing for their respective parties submitted before this court that a compromise has been entered into between the parties and a joint compromise memo signed by both the appellant and respondents has been filed today. Both
learned counsel have also signed in the said joint compromise memo. As per the joint compromise memo, the appellant has agreed to pay Rs.30,00,000/- (Rupees thirty lakhs only) to the respondents in lieu of 1/4th share, within a period of six months, i.e., on or before 26.01.2027 and the appellant is also willing to withdraw the appeal. The joint compromise memo is taken on record. In the event of the appellant failing to pay the aforesaid sum of Rs.30 lakhs within the period of six months, the respondents are at liberty to proceed the case in the final decree proceedings. Till the above period of six months, the final decree application filed by the respondents shall be kept in abeyance. 2.It is now submitted by the learned counsel for the appellant that only on mortgage of the property settled in favour of the appellant, he can pay the amount of Rs.30 lakhs to the respondents. For this purpose, the original settlement deed filed before the trial court is required for him. In such view of the matter, the appellant is given liberty to file a petition before the trial court 2/4 https://www.mhc.tn.gov.in/judis
AS No. 520 of 2026 for return of the original document. On such application being filed before the trial court, the document shall be returned immediately to the appellant within a period of one week from the date of filing of such application. 3.The joint compromise memo is recorded and the same shall form part of the decree. This appeal suit is disposed of in terms of the above joint compromise memo and with the above observations. No costs. Consequently, connected miscellaneous petition is closed.
