CRL OP No. 20174 of 2026 __________ Page2 of 4 ORDER The prayer in the Criminal Original Petition is to quash the proceedings in STC.No.103 of 2025 on the file of the Judicial Magistrate, Valangaimaan. 2. Upon perusal of the material records of the case, it can be seen that the allegation is that the victim died of an accident during the course of employment. The learned counsel for the petitioner submits that the petitioner is only a manpower agency referring people to various persons and for the negligence that had happened at the work site, the petitioner cannot be held liable. 3. In a case of this nature, when each of the accused pleaded their respective roles, the same has to be considered only after recording of the entire evidence and taking into account the wholesome consideration of the evidence otherwise it would amount to conduct a post mortem when the party is alive and everyone will allege that they are only playing different roles and ultimately, the said allegations cannot be entertained prematurely for the purpose of quashing the case. When allegedly some involvement of the petitioner is there, what is the exact role and whether his role is enough to satisfy the ingredients to convict the offences will be considered only at the time of trial. https://www.mhc.tn.gov.in/judis

4. Therefore, keeping open the liberty of the petitioner to raise all these grounds during the course of the trial, the petition is not entertained. Accordingly, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed. 5.
At this juncture, it is submitted that the compensation petition is pending and there is a likelihood of compromise. The disposal of this Criminal Original Petition will not in any manner hamper the petitioner or the other persons attempt to compromise the issue and always it will be open for the parties to approach this court also in the event of any compromise. 6. The learned counsel for the petitioner also pleads hardship for the petitioner to appear before the Trial Court. In view thereof, the presence of the petitioner before the Trial Court is dispensed with except for the necessary hearings as may be insisted by the Trial Court.
