ORDER The petitioner apprehends arrest for the alleged offence under Sections 140(2), 115(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 (BNS) in Crime No.178 of 2026 on the file of the respondent police seek anticipatory bail. https://www.mhc.tn.gov.in/judis
CRL OP No. 20396 of 2026 __________ Page2 of 4 2.The case of the prosecution is that on 22.07.2026, the defacto complainant was kidnapped by the petitioner and other co-accused for extortion of money. During the incident, the de facto complainant was assaulted and sustained injuries. Hence, the complaint. 3.The learned counsel for the petitioner submits that the petitioner is no way connected to this case and has been falsely implicated in this case and he has not committed any offences as alleged by the prosecution. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the petitioner has one previous case pending against him. Hence, she vehemently opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to the submissions made by the
learned counsel on either side and also perused the records available.
6. From the submissions made by the learned Government Advocate (Criminal Side), it is seen that the petitioner has one previous case of a similar nature. That apart, the present case involves an offence of kidnapping, which is highly serious in nature. Since the alleged occurrence took place recently on https://www.mhc.tn.gov.in/judis
