Heard the learned counsel appearing on either side and perused the materials available on record. 3. 4. In view of the above, the complaint lodged by the petitioner was enquired and closed by the respondents/police by an order dated 17.02.2026. Further, while closing the complaint, the petitioner was directed to approach the Real Estate Regulatory Authority or the Competent Civil Court for appropriate relief.
Since the entire allegations are that the petitioner had paid substantial amount to the promoter, even then the petitioner was not handed over possession of the constructed flat. Therefore, this Court finds no infirmity or illegality in the Closure Report dated 17.02.2026. 5. Accordingly, the Writ Petition is devoid of merits and the same is dismissed. However, the petitioner is at liberty to approach the concerned jurisdictional Civil Court by way of filing private complaint, if so advised. No costs.
