Also heard Mr. K.K Parasar, learned Addl. P.P appearing for the State. This petition under Section 482 BNSS is filed for granting the privilege of pre- arrest bail to the accused/petitioners, namely, (1) Aminur Rahman Mondal (2) Smti. Beauty Khatun (3) Smti. Masuma Bibi (4) Sri Aminul Hoque (5) Smti. Zinda Begum @ Zinata Begum @ Beli Khatun, apprehending arrest in connection with Gossaigaon PS Case No. 89/2025 registered u/s 103/3(5) of BNS corresponding GR No. 97/2025. The gist of allegation is about harassment and assault in the matrimonial home on 08.06.2025. Two of the named accused persons tried to forcefully make her consume poison and despite being taken to the hospital, she expired. In the Ejahar a reference was made to one suicide note allegedly made by the victim. Page No.# 3/3 The earlier bail petition has been rejected on 09.09.2025. It is submitted by the learned counsel for the petitioner that, in the meantime, accused No.1 of the FIR who is the husband of the deceased woman has already been released on bail. The present petitioners are said to be the family members of family members of the deceased. The Case Diary has been received. Though, investigation has progressed but is still not complete. The learned Addl. P.P submits that the FSL report regarding the alleged suicide note has come. I have perused the same. As mentioned in the FIR also, the petitioners were implicated by the deceased in her statement. Nevertheless, considering the progress of investigation and also the completion of forensic examination as part of the investigation, I am of the considered view that allowing this petition at this stage may not prejudice the investigation in any significant manner. In such view of the matter, it is directed that in the event of arrest of the accused/petitioners in connection with this case, they shall be allowed to go on bail on furnishing a bail bond of Rs. 25,000/- each with one surety each of the like amount to the satisfaction of the arresting authority and subject to the following conditions that; they shall co-operate with the remaining investigation, they shall not hamper or tamper with evidence; they shall not cause any harm or harassment or intimidation to the family of the victim. Violation of the condition shall entail cancellation of the bail petition. The anticipatory bail petition stands disposed of. JUDGE Comparing Assistant
