Also heard Mr. D P Goswami, the learned Additional Public Prosecutor appearing on behalf of State respondent. 2. This is an application u/s 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying for grant of pre-arrest bail to the petitioner namely, Shri Pritam Sutradhar in connection with Silchar P.S. Case No. 1019/2025 u/s 308(3)/351(2)/356(3)/75/77/79 of the Bharatiya Nyaya Sanchita (BNS), 2023. 3. It is submitted by Mr. Banik, the learned senior counsel that the present accused/petitioner and the informant had an intimate relationship and with some false and concocted allegation the informant had lodged the FIR against the petitioner. However, during the time of investigation he cooperated with the investigation and never had any apprehension of arrest. After filing the Charge Sheet the case was before the learned CJM, Cachar, Silchar and on 05.12.2025 after receipt of the Charge Sheet and taking cognizance summons was issued to the present petitioner. But, on the next day i.e. 19.02.2026, the petitioner could not appear after receipt of summons nor he could engage any counsel and for which on the day itself NBWA was issued by the learned Trial Court below. The next day of listing is on 18.07.2026. However, the petitioner is ready and willing to appear before the learned Trial Court below and to contest the case accordingly, if some interim protection is provided to him. 4. Mr. Goswami, the learned Additional Public Prosecutor submitted in this regard that there are considering prima facie case against the present petitioner, case has been charge-sheeted and the learned Trial Court below also took cognizance against the present petitioner. Accordingly, he insisted to call for the scanned copy of the TCR and Case Diary before passing any order of bail. Page No.# 3/3 5. Hearing the submissions made by learned counsel for both sides and I have also perused the case record and the annexure filed with the petition which reveal that the petitioner had cooperated at the time of investigation However, the NBWA was issued by the learned Trial Court below considering his absence on one date i.e. on 19.02.2026. 6. Considering all the aspects of the case, this Court is of the opinion that some interim protection may be provided to the present petitioner till next date fixed by the learned Trial Court below i.e. 18.07.2026 so that he appear before the learned Trial Court below. 7. In view of this, the anticipatory bail prayer of the present petitioner is hereby allowed and in the event of arrest the petitioner, namely, Shri Pritam Sutradhar, he shall be released on bail for Rs. 30,000/- with one surety of like amount and with further direction to appear before the learned Court below with a regular bail application, which may be considered in accordance with law. 8. The NBWA issued against the petitioner shall be stayed/suspended till next date of listing i.e. 18.07.2026. 9. With the above observations, the AB stands disposed of. JUDGE Comparing Assistant
