K RAJA REDDY, WORKING AS SUB INSPECTOR, PROBATIONARY AND EXCISE DEPARTMENT, GIDDALUR, PRAKASAM DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of Respondents 1 to 3 in considering petitioner’s representations dated 15-04-2025 and 26-04-2025, and the non- issuance of a medical fitness certificate or reasons for his non- selection for promotion to Sub-Inspector of Prohibition and Excise, as illegal, arbitrary, unconstitutional, and voilative of Sections 20(1 )- (5) of the Rights of Persons with Disabilities Act, 2016 and Articles 14, 16, and 21 of the Constitution of India and consequently direct Respondent 3 to forward petitioners case to the State Medical Board for re-examination of his medical fitness, and upon confirmation of fitness, promote the petitioner to the post of Sub-Inspector of Prohibition and Excise in any available vacancy, including Bottling Unit, Distillery Unit, Check post, or any Prohibition and Excise Station, with retrospective effect from 10-04-2025. In the alternative, if a disability is confirmed, direct Respondents 1 to 3 to provide reasonable accommodation by transferring petitioner to a suitable post with the same pay scale and service benefits, or place him in a supernumerary post until a suitable post is available or superannuation, as per Section 20(4) of the Rights of Persons with Disabilities Act, 2016 and pass such other orders. 3 IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased leased to direct the respondents to consider petitioner’s representations dated 15-04-2025 and 26-04-2025 and meanwhile grant an interim stay on further promotions or postings under Rc.No.68/2024/A2, including Rc.No.68/2024/A2-4, Dated; 10-04-2025 of R5, pending disposal of this Writ Petition, to prevent prejudice to petitioner’s rights and pass such other orders.
