Heard the learned counsels for the parties.
Perused the case diary.
It is the prosecution case that although the land in question was in the name of the father of the petitioner, the petitioner was in possession of the house from where the contraband was seized. Apart from that there are phone call records available for conversation between the present petitioner and another co-accused.
Considering the above, the other materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
