Learned counsel for the petitioner submits that the petitioner is in custody in connection with Sonari P.S. Case No. 50/2023 corresponding to Special POCSO Case No. 35/2023 for the offence registered under Section 376AB of the Indian Penal Code and Sections 4 & 6 of the POCSO Act, now said to have been pending in the court of learned Special Judge, Exclusive POCSO Act, Jamshedpur. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody since 24.04.2023. He submits that apart from the confessional statement of the petitioner, there is no legal material against the petitioner. 3. Learned counsel for the opposite party has opposed the prayer for bail. 4. The records of the case reveal that the victim was less than 12 years of age and it appears that the trial is at the fag end, as out of nine charge- sheet witnesses, seven have been examined till 10.09.2025. 5. This Court finds that there are direct allegations against the petitioner and the alleged offence is of heinous nature. Accordingly, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is rejected. 2026:JHHC:10607 2 6. However, the State is directed to ensure prompt production of the remaining witnesses during trial, so that the matter is taken to a logical end. 7. Learned counsel for the State is directed to communicate a copy of this order to the Director, Prosecution as well as Superintendent of Police of the concerned district to ensure prompt production of the witnesses on the date as may be fixed by the learned trial court. 8.
